Terms
Terms are 2% in 10 days, net 30 days with approved credit. To establish credit with Waytek, Inc.(Waytek), call us at 1-800-328-2724 and ask for a credit application, or complete a credit application on-line at www.waytekwire.com. Waytek requires three trade references and bank information. Visa, Master Card and American Express are accepted. All payments are due in U.S. Dollars. C.O.D. is acceptable with prior approval from Waytek. These terms and conditions supercede any prior Waytek terms and conditions.

Shipping
All shipments are FOB Chanhassen, MN. Waytek, Inc. may ship via UPS, FedEx or common carrier per your request. (Products over 150 pounds and/or bulky products are shipped via common carrier). Same day shipment is generally available on most in-stock products if orders are received by Waytek, Inc. before
2 p.m. central time. Expeditated order express service, air freight and other premium freight services are also available, additional fees may apply. All fees and duties are the responsibility of the purchaser. Inspect all shipments and report any shortages or damages to the delivering carrier immediately.

Prices
All prices are in U.S. Dollars. Prices do not include freight, duties, federal, state and local taxes. Call us to inquire about the availability of volume and/or quantity discounts. Minnesota orders will include a sales tax rate of 6.5% unless Waytek, Inc. has a then current tax-exempt certificate on file for that purchaser. Prices are not guaranteed and are subject to change without notice. Due to the nature of the copper market, copper wire and copper cable prices may fluctuate. Call us for then current pricing.

NOTE: A spool charge of $3 per spool may apply on non-bulk wire purchases. In addition, this spool charge only applies to line items of the same type, gauge and color regarding multiple spools.

Minimum Order
A minimum order is 100 pieces per line item or $5, whichever is less. A handling fee of $5 will be added to your total charges if the products purchased on a given order are less than $35. Combine your needs to eliminate the handling fee.

Limited Warranty:
All products provided by and through Waytek, Inc. are provided "as is" and with all faults. Special orders are non-cancellable and non-returnable. Other than special orders, new, unused and undamaged product may be returned to Waytek, Inc. within thirty (30) days from the date of purchase for a refund, replacement or credit to the original purchaser of the amount paid. Please call Waytek, Inc. at 1-800-328-2724 for return product information prior to shipping the product(s) to Waytek, Inc. The purchaser shall bear the cost of shipping and insurance on product(s) returned to Waytek, Inc.
THE FOREGOING WARRANTIES ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Waytek, Inc. shall in no event be liable to the original purchaser, its customers or to any other person or organization using or involving products purchased from Waytek, Inc. for the loss of use, loss of profit, inconvenience, property damage, personal injury or death arising out of breach of warranty, breach of contract, delay, negligence, strict tort liability or otherwise. IN NO EVENT AND UNDER NO CIRCUMSTANCES SHALL WAYTEK, INC. BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL LOSSES OR DAMAGES. The entire liabilty of Waytek, Inc for any claim of loss, damage or expense from any cause whatsoever shall in no event exceed, at Waytek, Inc.'s option, the repair, replacement cost or purchase price paid of the product purchased from Waytek, Inc. which directly gives rise to the claim. No action or proceeding against Waytek, Inc. may be commenced more than 12 (twelve) months after the product from Waytek, Inc. is initially shipped to the original purchaser.

Governing Law
Waytek, Inc. Terms and Conditions are governed by and construed in accordance with the laws of the State of Minnesota, without regard to or application of conflicts of law rules and principles. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms and Conditions to be unenforceable, that provision will be enforced to the maximum extent permissible so as to effect its intent, and the remainder of the Terms and Conditions will continue in full force and effect.
